Oregon Circuit Courts to Impose $10 Signature Fee
This information from John R. Bachofner, Bullivant Houser Bailey PC via the OADC Listserv:

Starting October 1, 2009, the Circuit Courts (including Multnomah County) will charge a $10 fee for orders submitted to the Court for signature. This includes ex parte orders and judgments. There are some exemptions for certain types of cases (Default judgments, Orders for guardians ad litem, Orders and judgments where previous waiver granted, Sex offender registration), but for most other common ex parte matters, the fee will be imposed.

Because this is a rather important issue, I called my contact at Multnomah Presiding Court to confirm the following logistics:

1. The fees need to be paid in advance in order for the Ex Parte Motion to be accepted. If the attorney does not have a receipt for payment, then they will be turned away. MAKE CERTAIN YOU ARRIVE EARLY ENOUGH WITH A CHECK TO GET IT PAID FIRST.

2. In order to pay the fees, someone will need to wait in line at the clerk’s counter to get the Motion fee paid. Before imposition of the fees, this could take 10-15 minutes. Now that everyone appearing at ex parte needs to pay in advance, the wait could be considerably longer.

3. Make certain that mailed ex parte orders include the fee. If they do not, the court will return the Order.

The court currently does not have any expedited method for paying the fees, such as attaching a check to the Motion and Order when presented at ex parte. A RECEIPT FOR PAYMENT is being required as of today. However, the court is considering options to streamline this process, such as coupon books for the fees, accounts, etc.

I do not yet know how other courts are handling these fees, but thought everyone would at least want to know about Multnomah County.
