We will examine the application of the HIPAA privacy, security, and breach notification rules to lawyers and law firms.  Our objectives are to provide an overview of the relevant HIPAA rules, specific compliance requirements in the legal context, and practical tips for remaining compliant in transactional and litigation scenarios.

KELLY T. HAGAN is a shareholder in the Portland, Oregon office of Schwabe, Williamson & Wyatt, P.C., where his practice emphasizes business transactions, including mergers and acquisitions, joint ventures, and provider contracting, and regulatory compliance in the healthcare industry, including fraud and abuse counseling and defense, health information privacy and security compliance, and data breach response.  He received his bachelor’s degree from Stanford University in 1975 and his law degree from the University of Oregon in 1978.  Mr. Hagan is a past-Chair of the Health Law Section of the Oregon State Bar, the section’s Committee on Medical Privacy, the Oregon State Bar’s Joint Committee on the Medical Profession, and is a past-President of the Multnomah Bar Association.  Mr. Hagan has lectured on health law-related topics at the University of Oregon School of Law, the Willamette University School of Law, Oregon Health and Sciences University, and the Oregon State University School of Public Health.  Mr. Hagan is a frequent speaker and writer on topics concerning medical privacy, is CIPP certified by the IAPP, and is listed in The Best Lawyers in America for health care law.
